AIRDEKO, LLC (herein “Airdeko”) offers its products with the terms, conditions and notices as follows:
Terms of Use
The product is offered to Purchaser conditioned upon Purchaser’s acceptance without modification of the terms, conditions and notices contained herein. The product has been designed for a specific use determined by Airdeko. Modification of the product(s) through use or misuse, application of additional components and/or removal of provided components, can lead to product malfunction causing serious risk. Risks include but are not limited to product damage, serious physical injury, disability and/or death. Purchaser is responsible for any modifications Purchaser performs on Purchaser’s or anyone else’s equipment, including product(s) purchased from Airdeko. Airdeko is not responsible and will not be held liable for any modifications done to equipment through the use or misuse of its product, including adding or removing components that alter the functionality of the product and/or improper installation and adjustment of Airdeko’s product. This product may not be used for unlawful purposes and such uses are expressly prohibited under the terms and conditions of its use.
Exclusive Obligation
This product may not be used for unlawful purposes and that use is expressly prohibited under the terms and conditions of its use.
Use Limitation
You may not modify, copy or reproduce this product. Airdeko covers are used to hide and protect the air conditioner unit. This product is designed for that purpose only. The product is not intended for standing upon, for step or for ladder uses; due to the risk of injury. This product should not be covered by any type of material, structure or vegetation or have any type of object on it or against it, as it may restrict the air flow required for the operation of the air conditioner unit.
Limitation of Liability
In no event shall Airdeko be liable for any direct, indirect, punitive, incidental, special consequential damages whatsoever arising out of or connected with the use or misuse of its products.
Additional Liability Disclaimer
AIRDEKO SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES ARISING IN THE AC UNIT BY THE USE OF AIRDEKO COVER (WHETHER INCURRED DIRECTLY OR INDIRECTLY). NEITHER AIRDEKO NOR ANY EMPLOYEES OR DIRECTORS OF THE COMPANY SHALL BE LIABLE FOR ANY DAMAGES TO THE AC UNIT.Indemnity
The Purchaser unilaterally agree to indemnify and hold harmless, without objection, the "AIRDEKO" Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages arising in their AC units from the use of AIRDEKO AC UNIT COVER.
Installation
Airdeko does not perform any installation of its product. The Purchaser is responsible for the assembly and installation of the product. The assembly and installation instructions provided by Airdeko are only as a reference. Airdeko will not be liable for any damages resulting from improper installation that would result in obstruction of air due to wrong placement of the cover. Further, the company has tested its product and the use of it, does not result in any obstruction to the airflow or efficiency of your product.
Other Statements
Airdeko employees or representatives, ORAL OR OTHER WRITTEN STATEMENTS, DO NOT CONSTITUTE WARRANTIES, shall not be relied upon by the buyer, and is not part of the contract for sale or this limited warranty.
Entire Obligation
The TERM OF USE, WARRANTY AND DISCLAIMER document states the entire obligation of Airdeko with respect to the products. If any part of this disclaimer is determined to be void, invalid, unenforceable or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effect.
General
This disclaimer statement is governed by the laws of the State of FLORIDA, USA. You hereby consent to the exclusive jurisdiction and venue of the courts of competent jurisdiction, USA, in all disputes arising out of or relating to the use of this product. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
